I don't understand why this hasn't been successfully challenged as a violation of "due process of law".

It has been, and it *is* crazy. If they demand you give them $25,000, they have to convict you of a crime, or levy a tax. But if they catch you with $25,000 in cash, they can decide to take it, and file suit against the money.

It goes against every notion of justice... but apparently a lot of powerful people like it.
